HOUSING AND ITS SOCIAL FUNCTION: THE CONSTITUTIONAL PROTECTION OF THE RIGHT TO HOUSING IN BRAZIL

Abstract

This article examines the protection afforded by the 1988 Brazilian Federal Constitution to the right to housing, investigating how the concept of the social function of urban property shapes

 or should shape  Brazilian housing policy. The research combines bibliographic and jurisprudential methods, drawing on specialized scholarship, relevant legislation, and precedents from the Federal Supreme Court and the Superior Court of Justice. Findings indicate that the legal system provides adequate tools for giving concrete effect to the right to housing, but that factors such as historical land concentration, weak public policies, and speculative underuse of urban properties continue to undermine its effectiveness. The article concludes that overcoming this situation requires, beyond sound legislation, genuine political commitment, sustained public investment, and active civil society participation in building more equitable cities.
